These Terms of Use ("Terms") constitute a legally binding agreement between you and A/S Fitness LLC ("we," "us," "our," or "Company") governing your access to and use of the TOVA mobile application (the "App"). By creating an account, downloading the App, or otherwise accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
TOVA is a nutrition coaching application that provides macro and food tracking, an AI-powered coaching assistant, educational content, and related wellness tools. The App is intended to support general health and wellness goals and does not provide medical advice, diagnosis, or treatment. Features and functionality may be added, modified, or removed at our discretion at any time.
You must be at least 13 years of age to use the App. If you are under the age of majority in your jurisdiction, you represent that you have your parent or legal guardian's permission to use the App and that they have reviewed and agreed to these Terms on your behalf. The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13.
To use most features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
TOVA offers auto-renewing subscription plans that unlock full access to the App's features. Current subscription options include:
Subscription Plans
Subscriptions may include a free trial period as disclosed at the time of purchase. If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period, and you will be charged the applicable subscription price, unless you cancel before the trial ends.
Payment is processed through your Apple ID account. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you originally agreed to unless changed and disclosed to you in advance.
You can manage or cancel your subscription at any time through your Apple ID account settings, under Settings → [Your Name] → Subscriptions. No refunds will be provided for partial subscription periods, except as required by applicable law or as determined by Apple's refund policies, since all payments are processed by Apple.
TOVA's "Ask Ally" feature and other AI-powered tools are not a substitute for professional medical, nutritional, or psychological advice. The App does not provide medical diagnosis or treatment. Always consult a qualified healthcare provider before making changes to your diet, exercise routine, or health regimen, particularly if you have an existing medical condition, eating disorder, or are pregnant or nursing.
Nutritional estimates, macro calculations, and coaching guidance provided by the App are generated using a combination of artificial intelligence, food databases, and general nutritional principles. These estimates may not be fully accurate and should be used as general guidance only. We are not responsible for any health outcomes resulting from reliance on information provided by the App.

The App, including all content, features, design, graphics, and underlying technology, is owned by A/S Fitness LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
We reserve the right to suspend or terminate your access to the App, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion. You may stop using the App and delete your account at any time through the App's account settings. Termination of your account does not entitle you to a refund of any amounts already paid, except as required by applicable law.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, A/S FITNESS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means prior to the changes taking effect. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
